Many people who go through the child support DNA Testing process are uncertain about what happens after the paternity test is completed. In this post, we will briefly discuss what occurs after your DNA results are positive and what happens if you are not the father.

What happens after a positive DNA test for child support in Florida?

Once your DNA Test confirms paternity through the Florida Child Support Agency a court hearing is held to establish the father’s legal rights. During the hearing, the judge will inform the father of his rights and responsibilities towards his child. Typically, this will include visitation rights, decision making and child support payments.

Shortly after the hearing, you should receive a copy of your acknowledgment of paternity form from Family Court. The document will serve as proof you are the legal father of the child. Another copy will be sent to the Vital Records Birth Certificate office and the father’s name will be added to the child’s birth certificate.

Private vs State Testing Time frames

Please note, that the process will differ slightly when performing a DNA test privately and not through child services or the state. Private genetic testing the turnaround time for the completion of your results will be in days as opposed to weeks. Depending on your situation, you will be able to submit a copy of your results to the judge yourself, or at the judge’s request, a copy of your results will be sent directly from the laboratory to the judge.

When performing a legal paternity test privately, it must be a legally admissible test performed by an AABB-Accredited laboratory to be recognized in Family Court. At-home DNA Tests are not admissible in court.

A final order of paternity is established and the child’s birth certificate is updated with the father’s name. ​

​A sample is collected for each child and each man believed to be the biological father. The mother and child may be asked to provide more than one sample if there is more than one possible father.

​​You will receive written notice with a copy of the test results when genetic testing is completed by the lab and the results returned. Results are normally available and mailed out approximately 2 weeks after samples for all parties to be tested are collected. Test results are not released over the phone.
