New York State Legal Requirements:

To ensure compliance with New York State Department of Health (NYSDOH) guidelines, one of the following documents are required to perform a paternity test.

  • A prescription from NYS licensed doctor.
  • A court order from a judge
  • A letter from NYS licensed attorney.

Legal Testing costs start at $350.00. Sample collection fees are not included in the cost of your paternity test.

How will my DNA samples be collected?

The standard method for DNA sample collection is a cheek swab. Blood samples provide a testing option with accuracy similar to buccal swabs.

Please note that the IDTO DNA Testing Center’s partner laboratory does not share any personal or genetic information with third-party companies.

All information provided to our partner laboratory is kept secure and will only be released to third parties with the explicit consent of the participants involved or by court order. DNA samples on file are kept for 3 months on average and then destroyed.

Are my paternity test results admissible in court?

Yes. Legal paternity test services we provide are legal admissible in family court.

The difference between a non-legal and a legal paternity test lies in the use of the results.

Non-legal DNA test results are for informational purposes only. Establishing a chain of custody is not necessary for non-legal tests.

Legal paternity DNA tests require a chain of custody. A third-party DNA sample collector must collect the samples. DNA samples are tested and analyzed by an AABB-accredited DNA testing laboratory.

Are results from at-home tests admissible in court?

No. At-home DNA test results are not admissible as evidence in court. These results do not establish a strict chain of custody or require an unbiased DNA collector to collect your samples, which is necessary for legal proceedings.

Although both legal and home DNA tests use the same testing methods, the lack of a verified chain of custody prevents home test results from being used in court.

Are paternity tests mandatory?

No. Paternity testing is voluntary. Permission is needed from the mother or legal guardian of a child under 18 and the alleged father.

Consent from all parties involved in a DNA test is required. Both parents must agree for testing when the child is under 18.
